August 14, 2007 Regular Monthly Meeting
REGULAR MONTHLY MEETING- August 14, 2007
The Town Board of the Town of Cooperstown, Manitowoc County,
Wisconsin, convened in open session on August 14, 2007 at 7 p.m., at
Town Hall for the purpose of transacting business as the Town Board.
Chairperson Ross Johnson called the meeting to order at 7 p.m.
Pledge of Allegiance.
Roll Call: Chair. Ross Johnson, Sup. Mike Albers, Sup. Fred Lemens,
Sup. Chad Collins, Treasurer Bernadette Duescher, Constable Nancy
Weber and Clerk Sue Kornely. Sup. Joe Havlovitz was absent. Four
residents were present. Dan Kasten and Randy Pelishek were also in
attendance.
On a motion by Sup. Collins and seconded by Sup. Lemens, the agenda
was approved on a unanimous vote.
On a motion by Sup. Lemens and seconded by Sup. Collins, the July 10,
2007, meeting minutes were approved with amendment on a unanimous
vote.
Reports
Treasurer Bernadette Duescher presented the Treasurer’s Finance
Report. On a motion by Sup. Albers and seconded by Sup. Lemens, the
Treasurer’s Finance Report were approved on a unanimous vote.
Roadman Dan Kasten presented Road & Equipment Report. Roads are the
same, a few wash outs and shouldering. Culverts are being checked.
Town cannot do its own bridge epoxy placement per phone call from Jon
Kropp. Estimate will be obtained. Paint job on Peterbilt. Johnson Dr &
Scanlan ditching will start next week. Sup. Lemens will get deed for
Johnson Dr from Register of Deeds.
Constable Nancy Weber presented the Constable’s Report. A letter was
resident on Lakeview- dog not on leash. On 8/1 lost dog on
Fisherville. Receiving weekly calls from neighbors on issue with
property on Zander Rd. Mr. Brey had contacted Constable. Constable
attended WTA meeting on zoning and land use. Tom Harris stressed issue
of conflict of interest and personal liability on your own insurance
policy.
Sup. Lemens presented the Plan Commission Report. - Plan Commission
meet on Aug 6th, Nancy Weber asked about rezoning a parcel from A3 to
R1, discussion on Rails to Trails and County Park, meet with Mr. Fels
from Maribel, Bill Angoli is working on procedure changes. Next
meeting September 10th.
Building Inspector Report- no report.
Chair. Johnson asked for public input. Robert Schleis asked about
replacement of an existing trailer with another mobile home. A letter
will be sent to WTA with a copy of current ordinance, asking for
specific on new home, vacant lot or compliance with current
ordinance.
Unfinished Business
Case# 07 CV 138 Nancy Weber and Russell Norman and Teresa Norman vs.
Town of Cooperstown. Clerk Kornely read the letter setting the date of
appeal at 45 days with notification by August 31st. On a motion by
Sup. Lemens and seconded by Sup. Albers, Sup. Albers will contact the
insurance company attorney on the appeal case. Upon vote, the motion
carried unanimously.
Ordinances, Resolutions and Agreements
Adoption of Application for Permit to Perform work within Town ROW
and fee structure. Sup. Lemens moved, seconded by Sup. Albers to
approve. Upon vote, the motion carried unanimously.
Agreements of new rates on intergovernmental- signed agreements
received from Town of New Denmark and Village of Maribel, signed by
Chairman Johnson.
Adoption of Operator licenses- Sup. Albers moved, seconded by Sup.
Lemens to approve license for Cheryl Philipps., Sup. Lemens moved,
seconded by Sup. Collins to approve license for Charles Philipps, Sup.
Albers moved, seconded by Sup. Lemens to approve license for Suzanna
Terrien, Sup. Collins moved, seconded by Sup. Albers to approve
license for Pamela Watzka . Upon vote, the motion carried unanimously.
Adoption of revised Building Permit Ordinance 2007-2 and Application-
Sup. Albers moved, seconded by Sup. Lemens to approve Ordinance 2007-2
and Application. Upon vote, the motion carried unanimously.
Public hearings and advisory votes
Discussion/Adoption of Emergency Government Management Plan- Sup.
Collins moved, seconded by Sup. Lemens to approve Emergency Government
Plan. Upon vote, the motion carried unanimously.
Discussion of Plan Commission Ordinance review and update- Sup.
Lemens request copy of old ordinance and presented Plan Commission
Ordinance changes.
Discussion of revisions to Roadman Contract- Removal of verbiage-
Part-time employee will work an 8 hour shift on Fridays from April
16th -Oct 14th for town coverage. Include verbiage- The time clock
will be punched daily to include start and end times, any job change
times and lunch break when feasible. Sup. Lemens moved, seconded by
Sup. Collins to approve the changes to the Roadman Contract. Upon
vote, the motion carried unanimously.
Discussion on issues presented with property on the corner of Zander
Rd and CTH R- residents have contacted the Constable over the last 6
weeks. Sup. Albers has also received calls. Police respond when
possible.
Discussion of participation in 2010 U.S. Census Local Update of
Census Addresses- Clerk will participate on behalf of town.
Information has been received.
Procedural motions by members of town board
Sup. Albers moved, seconded by Collins to appoint Sup. Lemens as
representative to County 20 yr Smart Growth Plan Committee. *
Constable Weber made a point of order on conflict of interest.* Upon
discussion and vote, the motion carried unanimously Sup. Collins
moved, seconded by Sup. Albers to approve checks. Upon vote, the
motion carried unanimously.
Correspondence reviewed. Signs- Zoning and Land Use cost $19.80 ea.,
No Fire Arms cost $20.93 ea., no trespassing cost $11.73 ea., post
costs $13.97 ea. Town does have some posts available. Constable Weber
presented the Board with information on the class for Humane officers
and cost of training.
Future meeting agenda: Renier refund, Case# 07 CV 138, discussion of
PC ordinance, trailer replacement w or w/o basement, opinion from Mike
Angoli, website
Sup. Albers moved, seconded by Sup. Lemens to adjourn. Upon vote, the
motion was carried unanimously. The meeting adjourned at 8:50 p.m.
