August 8, 2006 Monthly Meeting
REGULAR MONTHLY MEETING – August 8, 2006 The Town Board of the Town of Cooperstown met on August 8, 2006 at 7:00 PM at the Town Hall for the regular monthly meeting. Meeting called to order by Chairman Bill Enz at 7:00 p.m. Present other than Chairman Enz were Supervisors Joe Havlovitz, John Hager, Mike Albers and Fred Lemens, Treasurer Bernie Duescher, Constable Nancy Weber and Clerk Sue Kornely. Four others in attendance. Jeff Delmore from Scott Construction was also present. Pledge of Allegiance. Motion to approve agenda with Bay Lakes Report to be added to the agenda. Sup. Hager/Sup. Lemens. Carried 5/0. Minutes of July 11th- reviewed/motion to approve with amendments Sup. Havlovitz/Sup. Hager. Carried 5/0. Treasurer’s Report- reviewed/motion to approve Sup. Lemens/Sup. Albers. Carried 5/0. Citizens Input- Pam Kouba reported that she had received a phone call about a windmill possibility on a residents property and that they were going to look into before coming to the Board fro rezoning. Road and Equipment Report/Culvert Permits- Jeff Delmore reported that Scott Construction will be back for the balance of wedging and will contact the Town before starting. Chairman Enz reported that Kvitek Road looks good as does Schley Road, Hidden Valley Road and Harold Road. Culvert for Kelly Kane to be installed. Equipment has been working fine, cutting grass for the 2nd time, intersections cut way back. Before fall the grass will be cut all the way back. Vandalism to signs and posts. Clerk reported her mailbox and the side door of the Maribel Caves were vandalized. Chairman Enz reported crackfilling machine is ready to go. Constable Report- Nancy Weber reported that on July 17th the Town of Franklin requested she respond to a reported on horse neglect on Polifka Road, report was given to the Town of Franklin. July 19th responded to a residence on Rosecrans Road, took 3 beagles into the shelter. August 2nd, responded to a report of feral cats on Fairhills Rd, 3 more cats. Report of a pig on the Zander Road & Hwy R and a few lost dog calls. Plan Commission- Sup. Lemens reported that the PC is creating amendments to the PC ordinances, ordinance needs to be added to the September 12th Town Board agenda, working on Small & Large Windmill ordinance, Farmland Preservation has a conflict with Smart Growth Plan, Administration application and policy, and procedure format. Building Inspector- Clerk Kornely reported inspections completed for Wake, Sekora, Sand & Delsman. County Hwy R curb and gutter project/Waterline from Manitowoc to Green Bay- Chairman Enz reported on narrowing road statistic, guardrails & bridge abutments for slowdown deterrents & narrowing of lane makes them feel uncomfortable- 1997 study. Sup. Albers contacted the mail deliverer & read her letter, in her opinion the road should stay as is, the way they drive up the curb by the bar area gets them out of the line of traffic. Chairman Enz reported that the blacktop in from of Pat Bradley’s is 4” thick. Sup. Hager asked for a recommendation from the Board to move their mailboxes, discussion. Motion to leave the curb as is by Sup. Albers/Sup. Hager. 3/1, *Sup. Lemens & Chairman Enz no vote.* Carried. Treasurer Duescher reported that she had handed out assessment and charges, she read the letter to be sent. Motion to approve letter submitted, Sup. Lemens/ Sup. Albers 5/0 Carried. Further discussion on County curbing, Sup. Lemens will contact Gary Kennedy. Waterline digging under Devils River. SVRS Voting Systems- Clerk reported on public test on September 5th. Viking Rescue Squad Contract- Sup. Hager reported on the meeting at the Denmark Village, negotiation meeting coming up August 28th, Sup. Hager spoke with another VRS Board member asking for a meeting prior to negotiation, Chairman Enz reported that they a looking for clarification of assets, funding, muni service for another muni, language in contract that need to be straightened out- hours 24/7. Sup. Hager needs to go to the VRS Board of Directors. TRIP Program- Chairman Enz reported that per conversation with Gary Kennedy that cold mix was not funded by TRIP program, John Delmore has projects with cold mix that are TRIP programs in Sheboygan and Kewanee Cty and they are okay. Chairman Enz would like to see the hot mix used and the County’s bid was not 10% less, *cold mix would be considered acceptable, but used hot for longevity.* Sup. Albers reported that we have the funds for hot mix. Motion made to pave Herold Road with hot mix, Sup. Albers/Sup. Lemens 5/0 Carried. Discussion on Devils River entrance culvert and dip, no extra charge all included in bid for hand patch and chipseal of dip per Jeff Delmore. Motion made at Chairman’s discretion that up to $4000 can be spent for road improvements, Sup. Lemens/Sup. Hager 5/0 Carried. Motion to award Northeast Asphalt the bid of $65,520 for 1 mile of road- Zander to Hickory Grove, Sup. Lemens. Sup. Havlovitz asked for TRIP clarification, discussion. Seconded by Sup. Havlovitz. 5/0 Carried. Application for Permit to Perform work within Town ROW- discussion, motion table Sup. Albers/Sup. Hager. 5/0 C. Application for Culverts- discussion on town having the right to require the culvert to be longer for equipment, 22’ min, residents do request extensions to existing culverts Road Signing & Road Sign Quotes- letter from DOT read by clerk on HES funding, discussion, motion table Sup. Havlovitz/ Sup. Hager. 5/0 C. Emergency Government Management- Sup. Lemens would like to see one board member go through the plan and make adjustments to names and bring back to next meeting, Sup. Havlovitz will take a look at the plan, motion table Sup. Havlovitz/ Sup.Lemens 5/0 C. Four Year Road Plan- discussion, also discussed dust control on Johnson Dr, who and when were we last billed, Dan Kasten was going to talk to Dorner about watering road per Chairman Enz. Treasurer Duescher asked Chairman Enz if he would tour the road with John Delmore for 2007 road work and quotes for 2007 budget. Pine Drive was graveled this year. Board of Review Date- set for 6:45 on September 12th before Town Board Meeting 150th Town Anniversary- Sup. Havlovitz reported a complaint from a resident that they didn’t get a flyer and heard from another neighbor who did get a copy, thought that the approach might be illegal because it was put in a Press Gazette box and the solicitation of donations may not be legal. Also whether it was approved by the Town Board, Joe stated we had discussed, but no date set. Clerk reported that Sup. Hager was going to research history and was looking for volunteers. Sup. Hager reported no tax dollars being used; it’s the people of Cooperstown having a party. Pam Kouba asked how they were sent out and where were these put? She had not received one. Sup. Hager reported several people distributed them and he was not there. He put his on doorknobs. Pam Kouba stated his name was on them and it was your responsibility and that is illegal. Clerk reported she had contacted Gannett Herald Times and no authorization was given and that they could go back and bill use for circulation. She had also spoke to WTA Carol Nawrocki, she stated the town board need to approve the type of communication and the format being sent out. Also checks should be made payable to the Town of Cooperstown for accountability and for tax free deduction by resident. The Clerk’s recommendation is to mail a flyer to each resident with an approved agenda. Treasurer Duescher stated her in-laws got two, they are not residents of Cooperstown, Maribel residents also received. Sup. Hager stated the Village is included because it was part of Cooperstown. Sup. Lemens suggest we review the agenda, go through the approval process, that way it is the whole Town Board approving and not one individual and move forward. Sup. Hager stated it was not a government function and was put together by info from the people of Cooperstown. The Clerk feels that he did this in the name of the Town of Cooperstown and put the Board at liability by putting them in the newspaper receptacles. Sup. Hager stated it does no say by the Town of Cooperstown; it’s for the Town. Sup. Havlovitz stated it is representing the Town of Cooperstown. Pam Kouba asked amount the money collection? Clerk responded that it should go to the town for accountability. Sup. Lemens stated after approval, send the money to the town and note the money already collected. Sup. Hager stated if you want to make it a town Board party, there were people who did not want it to be as such. Sup. Lemens would like to correct it. Pam Kouba asked what the flyer says at the end- make checks payable to John Hager, so what does that mean?, who is having the party? Sup. Hager stated the town. No town dollars being spent, no tax dollars involved, gotta put the facts straight. The Clerk stated to Mr. Hager, you were given authority to research the history and find volunteers, you were not authorized to print, publish and post anywhere, those are facts. Sup. Havlovitz agreed. Sup. Lemens - it was in good intentions, in short notice, lets get it through the town now. Clerk would like Mr. Hager to admit that he overstepped his boundaries. Sup. Hager stated he did not feel he overstepped boundaries. Clerk asked were you given direction by the Town Board to do this? Yes or no. No response means you were not given direction. Sup. Hager stated it was not anything he did as a Town Board official, never claimed it to be his party, never claimed it to be anything but a party for the town of Cooperstown people, by the people, for the people, never claimed it to be anything different than that. Everything taken in will go out as door prizes, everything gone. A list where the money came in from, prizes will be given out and nothing will be left. Sup. Hager stated at the last meeting asked for volunteers. Constable Nancy stated what the previous months minutes said. Chairman Enz stated he felt Sup. Hager did this in good faith, the flyer should have come to the Board first. If it was wrongly done, it was in his opinion in good faith. Pam Kouba stated that the circulation was wrong. Sup. Lemens , we acknowledge that. The clerk stated that Sup. Hager will be responsible for the cost of circulation if we are billed and Sup. Havlovitz agreed, it was not the town that took action that would be John Hager. Constable Weber stated that campaign flyer distribution should have been a lesson and not to use someone else’s facilities. Chairman Enz asked the Board to reviewed the flyer. Sup. Lemens asked if someone would read it. Clerk read the flyer. Chairman Enz stated the checks be sent to the Treasurer and add 150th Year Sesquicentennial Celebration to the title. Discussion on how the place was chosen -Maribel Caves not enough parking, Sportsmen’s park no carry in and they charge, Maribel Lion’s Park is free (no tax dollars), music- records and cds (volunteer equipment), volunteers should contact John Hager, checks sent to Treasurer. Sup. Hager stated he spoke to another treasurer from another town, that they would not want the checks to come to them b/c of the bookkeeping with the town, he did not like that part. Clerk asked for that Treasurer’s name…Hager not available. Sup. Albers would like the wording of the flyer changed to the Town of Cooperstown Committee. Discussion of mailing costs, about 507 addresses plus Maribel. Top of flyer will read Town of Cooperstown Sesquicentennial Celebration hosted by the Town of Cooperstown Sesquicentennial Celebration Committee. Sup. Hager will turn over any checks to Treasurer at a meeting and will not open. Flyers will be mailed to the Treasurer’s PO Box. Clerk asked Sup. Hager how many volunteers he has and how many he needs? He stated none but has some for the day of the picnic. Sup. Hager wanted to have a pre-meeting at the Maribel Caves park, but only one person showed up. Sup. Hager has nothing for history, but has some contacts for the history- Leroy Verkuilin & Dan Gray, he has collected some things. It was to much to collect the history while trying to plan the party. The Denmark Press is running this week, will need to contact to change. Sup. Hager asked Sup. Albers if he could help with the history. Sup. Lemens asked if he had a citizen member to help. Leroy Verkuilen’s name was suggested. Request to move bills up- Motion to move bills up, Sup. Havlovitz/ Sup. Lemens 5/0. Carried. Bills - reviewed/motion Sup. Havlovitz/Sup. Lemens 5/0 Carried. Other Business- Constable Weber reported that Russell Norman- Pautz Rd had his mailbox damaged twice in the last 3 months. Sup. Albers reported on Bay Lake Conference- Alternate energy polices, DNR no show, Bio-solid converted to methane gas to electricity, solar energy towns may or may not want to regulate, wind energy and what effect the windmills have on your residency and your neighbors, Copy of Shawano County Wind Ordinance, Region Planning Energy Management, Chilton Windmills. Chairman Enz stated that Bill Schram wants to meet on Pleasant Rd bridge project, Humane Officer Training Course $500 fee- Constable will check on calls incurred by Manitowoc Cty. Discussion. Correspondence- reviewed, Dave Beine offered a $100 donation for Sesquicentennial Next Month's Agenda Items- Cty hwy R curb & gutter, waterline, SVRS, VRS contract, Application for Permit to Perform work within Town ROW, Road Signing & Road Sign Quotes, Emergency Government, Four Year Road Plan, BOR, 150th Anniversary Recap, WTA Convention, Truck, Humane Officer Course Adjournment- motion to adjourn Sup.
