February 13, 2007 Monthly Meeting
REGULAR MONTHLY MEETING – February 13, 2007 The Town Board of the Town of Cooperstown met on February 13, 2007 at 7:00 PM at the Town Hall for the regular monthly meeting. Meeting called to order by Chairman Bill Enz at 7:00 p.m. Present other than Chairman Enz were Supervisors Mike Albers, John Hager, Joe Havlovitz and Fred Lemens, Treasurer Bernie Duescher and Clerk Sue Kornely. Five resident, three non-residents: Dan Kasten, Dick Bradley & Randy Pelishek were in attendance. Pledge of Allegiance. Constable Nancy Weber was late. Motion to approve agenda with amendment to move Randy Pelishek to being on New Business and Morrison manure ordinance review to Unfinished Business Sup. Albers/Sup. Lemens. Carried 4/0. Sup. Hager abstained. Minutes of Jan 9th Reg Meeting- reviewed/motion to approve with corrections, the Citizens Input section will be re-written for next month Sup. Hager/Sup. Albers. Carried 5/0. Treasurer’s Report- reviewed/motion to approve Sup. Lemens/Sup. Havlovitz. Carried 5/0. Citizens Input- none. Road and Equipment Report/Culvert Permits- Roads breaking up, equipment running good, plow on Pete same as before-not twisting, bump on Hickory Grove Rd, signs torn down, no culvert permits, Chairman Enz spoke with Steve Honnef about culvert on Kvitek Rd and his brother contemplating one on Cooperstown Rd Constable Report- nothing to report, the family of Mr. Novak is taking care of his animal situation Plan Commission- report by Sup. Lemens: reported on the Feb 5th Meeting, Tom Kapinos submitted an application for the PC, discussed reason for Zeman’s rezoning request, discussed membership policy - Dave Blakeslee is taking over secretary duties & PC Chairman to be reviewed for April, discussed Rezoning pamphlet, and Bill Enz brought up Manitowoc County review of Randy Pelishek rezoning request, to go to the Town Board for review 1st. Chairman Enz presented a letter from Mike Dempsky that he (Chairman Enz) had no contact with him. Building Inspector- Clerk Kornely reported inspections on Marks (storage building inspect), Kane (insulation), Wagner (rough-in). County Hwy R curb and gutter project/Waterline from Manitowoc to Green Bay- Sup. Lemens reported still the same, County Hwy report on road repairs of Hwy R from Hwy 147 to Zander Rd, but were going to go all the way up. Chairman Enz reported that Hwy R would only be rebuilt from Zander Rd to Cty line (Hwy BB) for 2007. Viking Rescue Squad Contract- report by Sup. Hager: Village of Denmark basically rejected the Viking Board of Directors contract at Annual Meeting, Village of Denmark lawyers will be drawing up a new clause to be approved, and Town of Cooperstown will be getting a new contract to sign. Application for Permit to Perform work within Town ROW- Chairman Enz reported that Gary Kennedy had not sent the application. Tabled. Emergency Government Management- Sup. Havlovitz asked the Board for its recommendations on items to be added. Tabled. Morrison manure ordinance review - discussion/motion to table Sup. Hager/Sup. Lemens. Carried 5/0. Randy Pelishek Rezoning- Sup. Lemens and Sup Albers excused themselves from the Board. Chairman Enz presented the Board with a Rezoning Request for Randy Pelishek from A3 to A1 for a parcel of 1.8 acres on the NE corner of the intersection Hwy R and Pautz Rd for the purpose of a single-family home. Sup. Havlovitz reported he had requested that it be brought back to the Town Board for review before going back to Mtwc Cty, since it was presented twice to PC and shot *voted* down twice and that the Town Board voted it be rezoned which went against the PC recommendation, and sets a precedence. He asked for an new vote and to look at new things that were not presented the 1st and 2nd time and a new letter of recommendation be sent. Sup. Havlovitz reported that Randy Pelishek has sent him a packet to review. Discussion of packet. Bill Angoli spoke on the PC facts and findings. Sup. Havlovitz asked if Randy Pelishek would have to pay the rezoning fee again. Bill Angoli stated that would be the Board’s decision. Sup. Havlovitz requested that Randy Pelishek’s complete packet be resubmitted to the PC and not have to pay the fee and the PC can make a new recommendation to the Town Board and Board can make an updated recommendation to Mtwc Cty. Sup. Havlovitz asked Sup Albers why he sat out? Conflict of interest. Chairman Enz read minutes from Mtwc Cty P& P on Dec 6, 2002. Minutes addressed Nancy Weber’s requested A3 to A1 for 4.3 acres, Town Board had sent a letter to table until land use plan was completed, Ms. Weber would like the land rezoned in order to sell for a single-family home. She agreed to wait until the plan was approved. Chairman Enz stated that it is his intention the past decision should stand and Mr. Rasmussen said it should go back to the Town Board and that it has nothing to do with the PC. They wanted it brought back because we have a five member Board. Again Sup. Havlovitz requested the complete packet be sent back to the PC at no fee. Sup. Hager stated he call the Town’s Association and Mr. Rasmussen, the only option is to overturn to the vote. Discussion of certified map *from May 6, 2005* and the placement of the home. A motion was made to overturn the Town Board decision of approval and return to the Town Plan Commission by Sup. Hager/Sup. Havlovitz. Carried 1/2. Sup. Hager & Chairman Enz voted no. *Sup. Havlovitz voted yes.* Workers’ Compensation report- Motion for a closed session meeting on February 21st at 7 pm to review Workman Comp and employee compensation. Sup. Lemens/Sup. Albers. Carried 5/0. Operator License - Tiffany Dorton & Patronel Brouchoud- Motion to approve operator license for Tiffany Dorton. Sup. Albers/Sup. Havlovitz Carried 5/0. Motion to approve operator license for Patronel Brouchard. Sup. Albers/Sup. Havlovitz Carried 5/0. Ditch on Cooperstown Rd & Hwy R/Pipe under Cooperstown Rd west of Hwy R discussion- Chairman Enz stated there are no culverts anywhere on Cooperstown Rd and Hwy R. Richard Bradley property on north side of Cooperstown road collect water, road built at level of field, Richard Bradley bored a pipe under Cooperstown Rd into a drain tile on the south side of road owned by Pat Bradley. He didn’t request to bore under the road. Richard Bradley presented the Board with pictures of high water on Cooperstown Rd, shared responsibilities of the town road. Tile & pipe 8” with a surface drain on north and south side of road. Motion to pay for tile to alleviate water problem on Cooperstown Rd. Sup. Albers/Sup. Hager. Carried 5/0. Richard Bradley will submit a copy of the bill. Building Permits-non applicants decision- Chairman Enz would like to move on a forget the non- applicants since the new appraisal. Clerk stated that this would set a precedence. Sup. Albers stated if we let them go no one would get a building permit. Treasurer stated the Hank *Kouba* reported when a building permit was not taken out. Sup. Havlovitz would like a letter sent out stating it appears you have done some work and no permit was issued and a permit fee is due. Sup. Hager felt there were some that did not require a permit. Board will individually review the list and bring back to next meeting. Motion to table. Sup. Albers/Sup. Hager. Carried 5/0. Change March meeting to March 12th- Motion to move March meeting to March 14th. Sup. Hager/Sup. Havlovitz. Carried 5/0. Censure Reference- Motion to table until after the Citizens Input section of minutes from the January 9th is re-written. Sup. Albers/Sup. Lemens. Carried 5/0. Additives for salt and sand mix- Chairman Enz and Dan *Kasten* meet to discuss mix, pay about $11 per ton for sand and salt mix, additive would make the sand and salt last 4 time longer, cost $159.80 for 2 gallon sample, mix is 4 to 1, 1 gal to 21 ton, Motion to try product. Sup. Hager/Sup, Lemens. Carried 5/0. Fire numbers for rescue squad- Chairman Enz stated is was brought up again at the Rescue Squad meeting the issue of fire numbers, some residents have long driveways, homes with no number on mailbox, New Denmark has fire numbers and Rescue Squad is pleased with them, a sign that can be read from both sides close to the road. Motion to check on prices for fire numbering. Sup. Lemens/Sup. Hager. Carried 5/0. Stop sign on corner of Rosecrans Rd & Fisherville Rd- Motion to install a stop sign and stop ahead sign on the end of Rosecrans Rd, it is a T-intersection, Sup. Lemens/Sup. Havlovitz Carried 5/0. Bills - reviewed/motion to approve Sup. Lemens/Sup. Havlovitz. Carried 5/0. Other Business- WTA class: Bil-Mar March 24th- Sup, Lemens, Sup. Albers, Chairman Enz, Treasurer Duescher, Clerk Kornely and SC Grand March 3rd- Sup. Hager. Sup. Hager will notify of confirmation. Chairman Enz will also confirm. Sup. Havlovitz will not be attending. Motion to approve check for WTA. Sup. Albers. Sup. Hager. Carried 5/0. Correspondence- read/reviewed, Mtwc Cty Chapter 28 and amending Chapter 19, no check received from Eric Anderson, Maribel Grain fuel contract, Viking Rescue letter, Reconstruction Mtg for Cty Hwy March 30th, Bridge Funding Mtg- Milwaukee Feb 20th, Kocian is year and Pleasant in 2007 pre-talk, est. cost $90,560 plus ROW, Mtwc Cty P&P Randy Pelishek, Clean Sweep dates, salt shed inspection, census packet Next Month's Agenda Items- Cty Hwy R curb & gutter, waterline, Application for Permit to Perform work within Town ROW, Emergency Government, Workmen Comp Report, Morrison manure Ordinance, Operator License, Censure Sup.
