January 12, 2010 Town Board Monthly Meeting
TOWN BOARD MEETING January 12, 2010
The Town Board of the Town of Cooperstown, Manitowoc County,
Wisconsin, convened in open session on January 12, 2010 at 7:00 p.m.,
at Maribel Community Center, Maribel for the purpose of transacting
business as the Town Board.
Chairman Duckett called the meeting to order at 7:00 p.m.
Roll Call: Chair. Richard Duckett, Sup. Fred Lemens, Sup. Mike Albers,
Sup. Bill Enz, Sup. Jerry Skarda, Treasurer Bernadette Duescher,
Constable Weber and Clerk Sue Kornely. Five residents were present
and Dan Kasten.
On a motion by Sup. Enz and a seconded by Sup. Lemens, the agenda was
approved on a unanimous vote.
On a motion by Sup. Enz and a seconded by Sup. Lemens, the December 8,
2009 PUBLIC BUDGET HEARING minutes were approved on a unanimous vote.
On a motion by Sup. Enz and a seconded by Sup. Lemens, the December 8,
2009 SPECIAL TOWN MEETING minutes were approved on a unanimous vote.
On a motion by Sup. Skarda and a seconded by Sup. Albers, the December
8, 2009 SPECIAL TOWN BOARD MEETING minutes were approved on a
unanimous vote.
On a motion by Sup. Lemens and a seconded by Sup. Albers, the December
8, 2009 Town Board Monthly Meeting minute were approved with
amendments on a unanimous vote.
Reports
Treasurer Duescher presented the Treasurer Finance Report. Discussion.
On a motion by Sup. Enz and seconded by Sup. Skarda, the Treasurer’s
Finance Report was approved on a unanimous vote.
Road & Equipment Report- Dan Kasten reported welding on wing IH, new
battery in grader, grader not starting, blade on IH, *windshield wiper
motor* on Peterbilt, road sign thefts, sand and salt usage up from LY
about 20 yds for Dec. Lange signs are in.
Constable Report- Constable Weber reported dog on Dec 27th out of
area, tags on dog- dog was picked up, Dec 26th road sign down,
complaints on dogs at large Devils River area. Richard Duckett
received call on cattle on NN- Jerry Skarda responded. Call to
Ziegelbauer on Humane Society- no break in service at this time.
Sup. Lemens presented the Plan Commission Report. No meeting for
January 2010.
Sup. Lemens presented the Mtwc Cty Planning Advisory Committee Report.
Passed at County.
Clerk Kornely presented the Building Inspector Report. No report.
Public Comment: John Hager would like to see better information on
Plan Commission Rezoning procedures. Agenda items need to be spelled
out. Ex: Snow Removal- Private Driveway- liability.
Unfinished Business
Water Testing & Well Contamination/County Hwy R- Brown County Water
Authority Results- Testing Results- Discussion on spring water testing
again this year- $15 for each test. May share testing with another
town.
Town Audit- Schencke’s contract was a basic audit contract, with
random sampling. If the town wants a more thorough testing, specific
items to be audited need to be stated in the contract. On a motion by
Sup. Skarda and seconded by Sup. Enz to rescind the motion for a three
year audit with Schenke, approved on a unanimous vote. Letters to
Auditing firms with bid requests will be sent and a meeting with them
will be scheduled. Time of audit - one year for the year 2008 with
list of line items. On a motion by Sup. Enz and seconded by Sup.
Lemens, to submit bid requests on line items: 1. Review source
documents and other subsidiary records and compare amounts collected
to amounts due for the following revenue sources: Licenses and
permits, public charges for services, Intergovernmental charges for
services. 2. Compare all disbursements (check issued) to supporting
documentation; including vendor invoices and payroll time sheets.
Recalculate gross wages. Review for reasonableness of payment. 3.
Compare recorded check payee to payee on cleared check copy. 4. Verify
that all bank transfers were proper. 5. Issue a report on our findings
and recommendations, to constitute an audit, was approved on a
unanimous vote.
Hostek Bridge Replacement-Discussion. Sup. Lemens concerned with road
safety. Three Options:*at-grae crossing, replace bridge or leace as
is*. County recommendation TRIP D funds for road safety. Not heavily
traveled. Sup. Albers- mark the bridge well and leave it as is. Sup.
Enz speed sign for town protection. Signing- mile per hour and slow
sign. Nancy Weber feels this road is not a safety issue, if you spend
the money to straighten the roads you will then increase the speed on
the road and then you will have a safety issue. Discussion of speed
limit on road. On a motion by Sup. Enz and seconded Sup. Skarda to
improve signage on the road, was approved on a unanimous vote.
Temporary Help- Currently Bill Collins and John Rabenhorst are working
part-time. Chad Collins and Ross Johnson would be interested in
helping as needed. Paperwork will be completed.
Tire Replacement- Purchase of tires- Estimates provided to the Board.
Discussion. On a motion by Sup. Skarda and Albers, purchase of 8
Bridgestone711 tires at $269.00 plus mounting and stems, was approved
on a unanimous vote.
Public Hearings-Discussion and Action, if needed.
Board Input on agenda- will be addressed under future meeting agenda
item.
Plan Commission Rezoning Procedures- Sup. Lemens handed out a copy of
Town of Cooperstown Rezoning Procedure- formal application procedure,
clarification on certified survey, soil testing-suggestion preliminary
survey. Policy by ordinance. Clarification on when a soil test is
needed.
Code of Ordinances- Chapter 1- Town Organization- Amended- Reviewed
changes.
Town Attorney- Sup. Albers due to *slow* response by current firm.
Sup. Albers would suggest an attorney that specialized in municipal
government. Michael R Best firm. Our previous representation from
Attorney John St. Peter will be considered.
Operator License- Ron Falier- Maribel Sportsmen Club- On a motion by
Sup. Enz and seconded by Sup. Lemens, the operator license for Ron
Falier was approved on a unanimous vote.
Picnic License- St James Church On a motion by Sup. Enz and seconded
by Sup. Skarda, the picnic license was approved on a unanimous vote
Vehicle Accident Report- Plow Truck Repair- Drawing on accident report
is incorrect, #1 vehicle was not through the intersection, but on the
middle of the intersect. The fire dept asked the vehicles to be moved.
A citation was issued to John Rabenhorst. Reviewed repair quote for
truck.
Snow removal- Private Driveways- Reviewed Town Ordinance and discussed
snow removal across the road and into the ditch. Citations will be
issued as needed.
Posting of Draft Minutes & Draft Agendas- post to site as draft 14
days after monthly meeting or special meetings
Ordinances, Resolutions and Agreements
MOU- Statewide Voter Registration System. On a motion by Sup. Enz and
seconded by Sup. Lemens, the MOU from the Village of Whitelaw for
providing SVRS for the town, was approved on a unanimous vote.
Joint Powers Agreement between Manitowoc County Joint Dispatch Center
& Town of Cooperstown- On a motion by Sup. Skarda and seconded by
Sup. Albers to approve the Joint Powers Agreement between Manitowoc
County Joint Dispatch Center & Town of Cooperstown, was approved on a
unanimous vote.
Procedural motions by members of town board
On a motion by Sup. Enz and seconded by Sup. Skarda, checks were
approved on a unanimous vote.
Review of correspondence. WTA Meeting- January 21, 2010
Future meeting agenda: Feb 2010- Water testing, Town Audit, Ordinance
Discussion, Roadman’s Contract, Town Attorney, Vehicle Accident,
Industrial Waste Water Land Application Management Plan
On a motion by Sup. Lemens and seconded by Sup. Skarda, adjournment
was approved on a unanimous vote.
The meeting adjourned at 9:49 p.m.
