January 9, 2007 Monthly Meeting
REGULAR MONTHLY MEETING –January 9, 2007 The Town Board of the Town of Cooperstown met on January 9, 2007 at 7:00 PM at the Town Hall for the regular monthly meeting. Meeting called to order by Chairman Bill Enz at 7:00 p.m. Present other than Chairman Enz were Supervisors Mike Albers, John Hager, Joe Havlovitz and Fred Lemens, Treasurer Bernie Duescher, Constable Nancy Weber and Clerk Sue Kornely. Eighteen resident, Bill Daanen and Scott Janssen were in attendance. Pledge of Allegiance. Motion to approve agenda with amendments Sup. Hager/Sup. Albers. Carried 5/0. Minutes of December 12th Reg Meeting- reviewed/motion to approve with corrections Sup. Albers/Sup. Hager. Carried 5/0. Minutes of December 14th Public Budget Hearing- reviewed/motion to approve Sup. Lemens/Sup. Hager. Carried 4/0. Sup. Havlovitz was absent from Dec 14th meeting. Minutes of December 14th Special Town Meeting- reviewed/motion to approve Sup. Hager/Sup. Albers. Carried 4/0. Sup. Havlovitz was absent from Dec 14th meeting. Minutes of December 14th Special Town Board Meeting- reviewed/motion to approve Sup. Hager/Sup. Lemens. Carried 4/0. Sup. Havlovitz was absent from Dec 14th meeting. Treasurer’s Report- reviewed/motion to approve Sup. Albers/Sup. Havlovitz. Carried 5/0. Citizens Input- Sue Kornely read a letter to the Board, asking the Board to censure Sup. Hager and address Sup. Hager’s slanders accusations of her having committed a felony, his misrepresentation of elector’s statements and organization’s minutes, his reporting of a problem with the Annual Meeting rental at the MSC on Feb 14, 2006, his statement that the State Statutes stated postings were to be 72 hrs and 24 hrs for emergencies, when determined wrong he requested an ordinance to reflect his wishes, he used the Town’s Attorney for his own personal vendetta against the clerk, and his report that the Maribel Caves was on the Historical Registry at that he had spoke with neighbors concerning the property issues, he only spoke with one neighbor and she still believes that are issues. Sup. Hager over stepped his authority in organizing the 150th Anniversary event. He placed flyers in newspaper receptacles without permission after receiving a written warning from the Post Office for placing flyers in mailboxes. Sup. Hager denied making any statement that the Clerk had committed a felony. Sup. Lemens stated that all of the other issues have been previously addressed except the *issue of slanderous accusations* Chris Glandt made a statement to the Board, reporting on Sup. Hager’s comments that a new clerk is needed; because Sue Kornely had committed a felony in the way she recorded the minutesChris Glandt felt the Board should be aware and that Sup. Hager had overstepped his boundaries. .*Sup. Hager gave a rebuttal to the allegations.* Sup. Lemens asked for this to be moved to Other Business. Road and Equipment Report/Culvert Permits- report by Chairman Enz: snow fencing up, trucks are ready to go, salt has arrived, pot holes, checked into water on Hickory Grove Rd, conversation with Dick Bradley about Cooperstown Rd west, pockets of water, Dick Bradley bored under Cooperstown Rd to tile, asked if Town was willing to pay $1400 to get rid of water, no culvert on corner of Hwy R & Cooperstown Rd. No culvert permits issued. Constable Report- report by Constable Weber: possible animal abuse situation-Dec 28th & Jan 4th with residents permission -discussion on issue with family, may need to get court order to remove horse; lost dog found Plan Commission- report by Sup. Lemens: Meeting Jan 2nd Public hearing report, followed by Jan 2nd monthly meeting Building Inspector- Clerk Kornely reported inspections on Kane (under-floor plumbing), Lemens (insulation), Kane (rough-in). County Hwy R curb and gutter project/Waterline from Manitowoc to Green Bay- Sup. Lemens contacted WTA with rough draft letter, WTA felt the Town should let Pat Bradley & Bonnie Reedy make an agreement with the Manitowoc County Hwy Dept on the curbing on Hwy R Viking Rescue Squad Contract- report by Sup. Hager: Town of New Denmark wants items re-written in the contract, State Inspector stated that all municipalities should have the same contract, Town of Cooperstown would have to resign a new contract, Chairman Enz read a recap of calls and patients for each municipality. Sup. Hager reported on 30-day cancellation date changed for both parties to be the same. Application for Permit to Perform work within Town ROW- Chairman Enz reported that Gary Kennedy had not sent the application. Tabled. Emergency Government Management- Sup. Havlovitz covered the drafted plan with Board, asked Board to review and comment with changes. Tabled. Daanen & Janssen Rezoning Request from Plan Commission- Sup. Lemens presented the Board with minutes from the January 2nd Plan Commission meeting. Chairman Enz gave speakers 3 min each to speak. Scott Janssen asked the Board for approval on a change from A3 to C1. Bill Daanen spoke of other uses for the land. Chairman Enz read the oppositions from the minutes. Nancy Burda asked about others making a request for change, how would you say no to them. Jennifer Brunner asked about campground & 18 acre lake, what about water table and wells? Chairman Enz questioned the reclaim proposal with the County. LuAnn Collins asked could there be camping? Nancy Skaletski stated she spoke with two real estate agents and the value of her farm would go down. Tom Kapinos also spoke with a real estate agent and his market value would be affected. Sup. Albers questioned if the closure plan would still be in effect based on the zoning requirement, how long will you be mining? (about 15 years), discussion on fees for any open acres. David Blakeslee was questioned why he voted yes, conditional use issue was a separate issue. Sup. Lemens stated County takes into consideration a conditional use permit. Sup. Albers stated previous conditional use permits for gravel pits on an A2 parcel -approved. Chairman Enz questioned reclaim process and fees. Scott Janssen explained reclaim process & fees, conservancy made the most sense. David Blakeslee-conservancy would convene the land set aside as in the Plan for non-development vs. development, conditional use would sort out the rest & put conditions on the land. Sup. Lemens stated A3 keeps it open-doesn’t meet Comprehensive Plan-passive use. Sup. Albers- not sure he would like this developed in his backyard. Scott Janssen would if for recreational use. Plan Commission vote was 3 no & 2 yes. Motion to deny from A3 to C1 request Sup. Havlovitz/Sup. Albers. Carried 5/0. Letter to be sent to County. Manitowoc Cty Joint Powers Agreement- Motion for approval Sup. Hager/Sup.Lemens. Carried 5/0. Jim’s Excavating Proposal- Motion for approval on proposal for $10.58 per yard screened sand, Sup. Albers/Sup. Lemens. Carried 5/0. Ordinance 2007-1 Ordinance Amending Section1.7 Building Permit & Inspection Fees- signed by Chairman Enz. Veolia Environmental Services Contract- Waste & Recycling Pickup- Signing- signed by Chairman Enz Tennesssen Appraisal Contact- Signing- Contract signed. Discussion & Status of Maribel Caves Inn- Chairman Enz reported the north end of the building had been cleaned out to the floor, Bob Jr is talking to engineers, roof on both buildings, making good progress, 10 years before functional buildings, remodel permit was given to Bob Jr for review by their sister. Sup. Lemens spoke with all three. They discussed trespassing issues. Sup. Lemens talked about the County Park improvements. Clerk Kornely presented a survey of the neighbors of the Maribel Caves Inn and Cherney Maribel Caves Park. Constable Weber reported on past police reports and issues. Sup. Havlovitz asked if Sue Kornely could mark a calendar when she sees people entering the property. Chairman Enz suggested they put motion cameras on the property. Clerk Kornely submitted the National Historic Registry sites and the Maribel Caves Inn is not on it. Ballot Placement- Nancy Burda pulled the names for placement on the ballot for February 20th primary for town supervisor, 1st Nancy Weber, 2nd John A. Hager, 3rd Hank Kouba, 4th Fred Lemens and 5th Chad Collins. Other Business- Constable Weber reported on a fire call and that a burn permit was not issued, citation was issued. Sue Kornely restated her issues to the Board and asked for Sup. Hager to tell the Board what felony was committed. Sup. Hager stated he never said Sue committed a felony, the State of Wisconsin states incorrect statement are a felony. Sup. Lemens thinks this is a personal disagreement, but does not want to overlook anything. Sup. Havlovitz asked for a reference to censure. Sup. Albers asked for information on the Workman Comp claim. Chairman Enz asked for next meeting to dig up all correspondence Sup. Albers asked about the Morrison manure disposal. Clerk will mail a copy to each board member. Clerk presented copies of Dan’s overtime timecards. Clerk reported the town would be doing a hand count on the ballots due to cost of setting up the machine because of the low count of voters for a primary. Bills - reviewed/motion to approve Sup. Albers/Sup Lemens. Carried 5/0. Correspondence- read/reviewed.
