REGULAR MONTHLY MEETING- May 13, 2008 The Town Board of the Town of Cooperstown, Manitowoc County, Wisconsin, convened in open session on May 13, 2008 at 7:00 p.m., at Town Hall for the purpose of transacting business as the Town Board. Chairman Johnson called the meeting to order at 7:00 p.m. Pledge of Allegiance. Roll Call: Chairman Johnson, Sup. Fred Lemens, Sup. Mike Albers, Sup. Chad Collins, Sup. Richard Duckett, Treasurer Bernadette Duescher, Constable Nancy Weber and Clerk Sue Kornely. 37 residents were present. Dan Kasten, town employee was present. Representatives present: Bob Ziegelbauer, James Blaha, Jerry Halverson, Mike Hanaway, Dave Korenck, Rep from Brown Cty Conservation Office, Scott Construction representative. Board realigned the agenda with the Water Testing & Well Contamination follow-up to the beginning of the meeting followed by Water Testing Representative and Public Comments. Water Testing & Well Contamination follow-up: Bob Zeigelbauer opened the meeting, collective thought to begin the discussion, introduced Jim Blaha, Jerry Halverson, Gary Kennedy, Reed Gadtke, Tom Tews, Mike Hanaway, Kelly O’Connor. Jerry Halverson gave a history on bad well report in January and the January thaw. Five out of 6 wells tested positive in February. A retest came back okay. In March retest of wells within ˝ mile radius of St James church showed nitrates either animal or human waste or industrial & ecoli. Discussion of karst area- high bedrock and shallow soils, 6-20’ soil on top of rock, type of soil- Hortonville; a scattering of porous soils, fractured bedrock under soil with horizontal and vertical cracks, sink holes, ditch holes, and swales in field. Land has been walk, looking for sinkholes. At the meeting with Green Bay Water Authority, the discussion of ditch holes to plugged that stretch from the Cty line south. Discussion of waste spreading on fragile soils and the discontinuation of that spreading. Discussion of Nutrient plans. Six unused wells have been found. The possibility of septic leaching, when was your last septic inspection, did you have a bad well to start with, and ponds could be a potential issue. High nitrates have been an issue for sometime in the area. John Heiser (Cooperstown) asked what about nutrient plan for cattle wash just over the Cty line? What can we do in Manitowoc Cty? Ann Zielinski (Gibson) was DNA testing done? Mike Hanaway reported on bacteria testing. Don Dickrell’s tests were positive for ecoli and coliform, based on clearing results- no DNA tests were done. Judy Treml (Luxemburg) asked about DNA testing result taking 6 months? In Florida results are available in 5 days. Jerry Halverson discussed the thaw and refreeze in January. If you look at one source only-you could miss out on the possible issue. Rep from UW Oshkosh, Maureen Maldoon reported on the ground water recharge period, winter spreading may be found in the spring drinking water, uniform rules do not make sense as the land all over is different. Russ Tulii (southern part of Cty) asked about Cty tax payer money $10,000 to look at issue Discover Farms and about the Karst task force report? Bob Zeigelbauer would like to focus on the Town of Cooperstown area. Mike Zielinski (Gibson) asked about holes in ditch? Jerry Halverson explained about the settling in ditches. Bill Angoli (Cooperstown) asked if there was no problem before, could the pipeline have caused the water to flow along the pipe and get into the fractured rock? Nancy Stangel (Cooperstown) questioned why nothing has been done to offer to bring water into our community? Jerry Halverson reported no one has called. Bob Ziegelbauer replied people are not bashful to ask for help. Judy Treml reported she was contacted by town residents because the DNR and Cty have done nothing. Bruce Smeester (Cooperstown) asked as a resident, he was never contacted by the town. Jim Zipperer (Cooperstown) asked the DNR and Mtwc Cty Hwy, over a year ago, about the runoff from farm milk house into ditch. He was told it is not regulated. Judy Treml read a recap of issues in the well contamination in the Town of Cooperstown after being contacted by resident in the affected area. What steps did the DNR not take? Don Dickrell reported he took a sample to Green Bay after result, he contacted the DNR and the Health Dept, and then well testing occurred. He contacted the well drillers on his own in January. On Monday he tested and they drilled the well on Tuesday. Don paid the bill and then he received the compensation. Jim Blaha was on the site at the time of drilling. Ross Johnson (Cooperstown) asked why the waterline was in the ROW? Gary Kennedy reported we have no choice in the ROW. Sue Kornely (Cooperstown) asked who signed off at Cty to allow it to go through our Cty. State granted the permit. Fred Lemens (Cooperstown) asked Tom Tewes about the paunch waste (industrial waste) in Cooperstown (area 1 & 12) and Gibson. Some areas just over Cty line are allowed industrial waste. Mike Albers (Cooperstown) asked Tom Tewes about the amount allowed to be placed on the fields. Tom Tewes reported it is based on the crops and nitrates. MaryEllen Heiser (Cooperstown) asked who checks and how often? Complaints are filed. Report they are in compliance. Larry Wohlwend (Cooperstown) asked about spreading of weigh on the fields. Do they have to have a permit? Do they have to show you the permit? Ann Zielinski (Gibson) asked about how many issues would be eliminated if liquid spreading was banned. Mike Hanaway feels it is the fragile area and the rain on top of snow. How do we get better land use management? Fred Lemens reported Morrison put in a winter land spreading ordinance, but it has to be enforceable. Jerry Halverson asked how do we continue the conversation? Mike Hanaway stated only those in the contaminated area are eligible for drinking water. Ross Johnson asked Jim Blaha will there be more testing? MaryEllen Heiser asked about clean up of the land and the stop of contaminates. She asked about putting in a new well, it will not help if the contaminates are still there. Maureen Maldoon reported spring water levels rise, contaminates get in, summer and winter are less. She reported recharge occurs any time we have a snow melt event. Discussion of water treatment system in the home. This is a home owner’s decision. Mike Hanaway stated there are never any guarantees. If systems are not kept up, you will have a false sense of security. Dave Korenck reported funding could apply to the hookup to water line. John Heiser asked about reverse osmosis? Mike Hanaway & Jerry Halverson stated it will reduce the nitrate but will not take out the bacteria. Question on water purification system will takes out bacteria and give peace of mind. Question on what is the plan for the future? Fred Lemens asked should we have a contact person? Jim Blaha is the contact person in place. Ross Johnson stated he will not be hauling any paunch. He doesn’t want to contaminate your well or his well. Michelle Hoogland asked does dry manure breakdown better than liquid? Jerry Halverson replied based on the amount applied. Ann Zielinski asked about a stricter local ordinance. Maureen Maldoon reported Five Counties (group) have asked the State to address the karst area in a report. Report is available online. Tom Tews meet with Green Bay Dress Beef and has addressed the issue and the removal of Town of Cooperstown (section 1 & 12) as approved sites. Discussion on digester. Bob Remiker (Cooperstown) gave a recap on the ditching issue in the area. Gary Kennedy stated hopefully it has been addressed, and they are looking at a possible resolution. Green Bay Water Authority will have some type of resolutions next week. Bob Ziegelbauer stated we will come back as often as needed, just call us. We will try and help in as many ways as we can. Mike Hanaway discussed option of funding compensations (based on $65000 household income) on new well, also discussed a sanitation district. Open Discussion ended at 9:15 pm. Next meeting June 17th @ 7 pm. Water Testing Representative- Michael Hanten from Clean Water testing reported on types of tests, reduced rates for large sampling site, program format, it is illegal to install treatment system in known contaminated area before correction. Testing on a regular basis is the property owner’s responsibility. Discussion of drop off and a single pickup site on one day for all samples. No minimum. Test $26. Discussed a Base test. They can pickup Monday thru Thursday. On a motion by Sup. Collins and seconded by Sup. Lemens, the April 10, 2008 Town Board Meeting minutes, were approved. On a motion by Sup. Lemens and seconded by Sup. Albers, the April 22, 2008 Special Meeting minutes, were approved with corrections on a unanimous vote. Reports Treasurer Duescher presented the Treasurer Finance Report. On a motion by Sup. Collins and seconded by Sup. Lemens the Treasurer’s Finance Report was approved on a unanimous vote. Roadman Dan Kasten presented Road & Equipment Report. No changes to report on equipment. All equipment is running fine. Roads are mostly patched, except for Pautz Rd and Pantzlaff Rd. Johnson Dr is ready for blacktop. Constable Weber presented the Constable’s Report. April 18th, Cty Sheriff called on horse on Cty Z & NN. May 5th, debris on Pleasant Rd, and on May 10th, resident in Cooperstown’s child was bitten by animal. Constable Weber attended the Lawyer Conference. Sup. Lemens presented the Plan Commission Report. No meeting due to absence of three members, an application was taken from Paul Rameker. Sup. Lemens presented the Mtwc Cty Planning Advisory Committee Report. No meeting due to Open House. Chairman Johnson reported on the Viking Rescue Squad. The Committee, Village of Denmark and Town of New Denmark meet. The Village of Denmark and Town of New Denmark are for the buyout. Village of Maribel and Town of Cooperstown were against buy out. Clerk Kornely present the Building Inspector Report- Post (rough-in inspection) Unfinished Business Rezoning John Kittell from table- County sent Kittell back to town, Conditional Use, A3 usage. Sup. Lemens will contact County. Public hearings and advisory votes Open Book May 27th & Board of Review June 11th Members on the Board of Review will be Clerk Kornely, Sup. Albers and Sup. Lemens Hwy maintenance expense report- Treasurer Duescher reported about $90000 available for road work, $45611 for blacktopping Johnson, balance for chipsealing $60000 to $65000. Road Work Bids- Discussion of bids submitted. May 27th at 6:45pm next meeting. Road review on May 21st at 6 pm. Appoint one new Plan Commission member- Tom Kapinos, Mae Enz and Lloyd Pantzloff submitted applications. Chair Johnson nominated Tom Kapinos. On motion by Sup. Collins and a seconded Sup. Lemens, Tom Kapinos was approved on a unanimous vote. Chairman Johnson appointed Sup. Fred Lemens as Chairman of Plan Commission. Ordinances, Resolutions and Agreements Procedural motions by members of town board On a motion by Sup. Albers and seconded by Sup. Collins checks were approved on a unanimous vote. Review of correspondence. Ross to attend Cty Hwy meeting on Thursday May 15th, Efficiency grant $902.14, Recycling grant $11022. Fleet farm bill, New Denmark work Future meeting agenda: John Kittell Conditional Use, water testing, New Denmark rates, New Denmark Contact person, Liquor & Operator License, On a motion by Sup.
