November 10, 2009 Town Board Monthly Meeting
TOWN BOARD MEETING November 10, 2009 The Town Board of the Town of Cooperstown, Manitowoc County, Wisconsin, convened in open session on November 10, 2009 at 7:00 p.m., at Denmark State Bank, Maribel Branch for the purpose of transacting business as the Town Board. Chairman Duckett called the meeting to order at 7:04 p.m. Pledge of Allegiance. Roll Call: Chair. Richard Duckett, Sup. Fred Lemens, Sup. Mike Albers, Sup. Bill Enz, Sup. Jerry Skarda, Treasurer Bernadette Duescher and Clerk Sue Kornely. 2 residents were present. Dan Kasten were present. Nancy Weber 7:08 pm On a motion by Sup. Enz and a seconded by Sup. Skarda, the agenda was approved on a unanimous vote. On a motion by Sup. Enz and a seconded by Sup. Albers, the October 6, 2009 Closed Session Meeting minute were approved on a unanimous vote. On a motion by Sup. Enz and a seconded by Sup. Lemens, the October 6, 2009 Regular Monthly Meeting minute with amendments were approved on a unanimous vote. On a motion by Sup. Skarda and a seconded by Sup. Lemens, the October 20, 2009 Public Hearing minute were approved on a unanimous vote. On a motion by Sup. Enz and a seconded by Sup. Albers, the October 20, 2009 Town Board Meeting minute were approved on a unanimous vote. On a motion by Sup. Albers and a seconded by Sup. Skarda, the October 20, 2009 Budget Workshop Meeting minute were approved on a unanimous vote. Reports Treasurer Duescher presented the Treasurer Finance Report. Discussion. On a motion by Sup. Enz and seconded by Sup. Albers, the Treasurer’s Finance Report was approved on a unanimous vote. Road & Equipment Report- Dan Kasten reported axles on grader, leak checked, IH new spring brakes, new pressure washer arrived, grassing cutting about 90% complete. Snow fence post partially put in. Fiberglass repair on Peterbilt truck –discussion at future meeting. Sup. Enz reported on repair estimates for grader. Labor- Brooks Labor $1000- Havlovitz Labor $500- Koenig Labor $750 – Jaeger Labor $45 per hr. Discussion. No action. Snow fence posts in the ground 642 installed. Constable Report- Constable Weber reported Oct 21st dog call- 2 dog tags not up to date- taken to shelter, Road sign on Kocian Rd and Remiker Rd missing. Discussion on replacing stop signs and adding road sign to top of stop sign, brackets need to be ordered. County Constable Meeting report- Sheriff reported half time positions eliminated and will not being replaced- budget cuts. Sup. Lemens presented the Plan Commission Report. Plan Commission meet on Nov 2, 2009. New business- John Hager rezoning change unapproved Plan Commission minutes and replaced with rezone hearing comments. Randy Pelishek removed unapproved Plan Commission meeting minutes and replaced with rezone hearing comments. On the first page under motion 2009-2 removed created as absent and under recommendation deleted and replaced with Town of Cooperstown Plan Commission recommends denial. Old business- 20 Comprehensive Plan update, change of rezoning procedures. Next month: discuss working land initiatives, digester, review procedures for rezone applications. Sup. Lemens presented the Mtwc Cty Planning Advisory Committee Report. Open House- Maribel on November 18th from 5-8 pm. Final meeting on MCPAC. Clerk Kornely presented the Building Inspector Report. Report- no inspections in October. Check Builders are again in good standing with the State of WI. Devils River Campground is having some swimming pool work per State Report- working with Mike Angoli to see if inspections are needed. Public Comment: Carla Halvorson running for County Executive for Manitowoc County introduced herself. Bill Enz reported residents are happy with emergency response signs. Lange submitted additional addresses. Fred Lemens- Board input on agenda. Richard Duckett spoke about Board member asking for item to be added to agenda, but no discussion. Fred Lemens spoke in objection to previous comments by town clerk in regards to knowledge of letter two weeks in advance of Plan Commission meeting and objected to the comments on him having a policy of term limits of Plan Commission members. Unfinished Business Water Testing & Well Contamination/County Hwy R- Brown County Water Authority Results- Testing Results- Chair. Duckett spoke with Halvorson no new information. No action. 20 year Comprehensive Plan Discussion- no action. Public Hearings-Discussion and Action, if needed. Budget Meeting Date- December 8th at 7 pm followed by Town Meeting, followed by Board meeting. Hostek Bridge Replacement-Discussion, Sup. Lemens reported the DNR will be paying for tressel upgrades. Hostek Bridge is not slated for repair. Chair. Duckett would like Sup. Lemens to work with County on the Hostek Railroad Bridge Replacement. On a motion Sup. Albers and seconded by Sup. Enz, Sup Lemens will represent the Board on Hostek Bridge replacement discussion. MCPAC meeting attendance payment- Action On a motion by Sup. Skarda and seconded by Sup. Enz to pay alternate for meeting attendance $30 per diem. Grader repair- Tabled. WTA recap- Sup. Albers- financing at State level, weight limits on road- ag and forest, Local Road Improvement, Siting Facilities, Rural Development USDA – available funding, Managed Forest Law, Updates on Madison. Sup. Lemens- Broadband, NR115, Working Land Initiatives- farmland preservation, conditional use permits. Municipal Clerks Association- Discussed services provided by MCA. Dilapidated buildings- Discussion. Board members will drive by at their leisure. Tabled. Tape recording access- open records- Discussion. Chair. Clerk will recording meeting until further notice. Chair. Duckett sent a letter to Town’s Attorney regarding taping of minutes by Supervisor and read the response. Sup. Lemens still feels that these are still his private, but will hand over the tapes for the September and October meeting and the Plan Commission September and November meetings. The Plan Commission will purchase a tape recorder and tapes. Town Audit- Discussion. Kerber, Rose & Associates- Audit $5200 for one year. Schenke for 2009 would cost $3200 for financial review plus $1700 for audit for $4900. On a motion Sup. Skarda and seconded Sup. Lemens to remain with 3 year audit by Schenke. Voice vote: Sup. Albers- no, Sup. Lemens- yes, Sup. Skarda- yes, Sup. Enz- yes, Chair. Duckett- no, motion carried. Sup. Albers will contact Schenck for 3 year audit – years 2006, 2007 & 2008. TRIP fund- Discussion. Town of Cooperstown is slated for 2013. Culvert report- Discussion. Diedrich culvert and driveway permit at no charge. Paunch & Digester- New Denmark- Discussion/Update- Sup. Skarda reported paunch being hauled into Mazna farm, permits have been obtained. Digester toured, will not be in operation until Spring 2010 in the Town of New Denmark. Testing of product. Working with County and DNR, delay due to permits, issues went this fall. Sup. Lemens reported it as a plus being on County Rd, benefits from the products. Chair. Duckett reported it as a positive. Ordinances, Resolutions and Agreements Bridge Aid- On a motion by Sup. Lemens and Sup. Enz bridge aid of $36095.30 for the contract. Procedural motions by members of town board On a motion by Sup. Skarda and seconded by Sup. Enz, checks were approved on a unanimous vote. On a motion Sup. Lemens and seconded by Sup. Skarda payment to MTA for holiday meeting. Review of correspondence. Manitowoc County Recycling Center, Lakeshore Humane Society Service Contract Proposal, Village of Maribel would like to be contacted before the Town Constable responds on their behalf, they have paid the bill incurred when the County Sheriff’s Dept asked the Town Constable to respond to direct traffic during a fire call, Fire Inspection Report Future meeting agenda: Dec 2009- Dilapidated buildings, 20 year Comp, Waterline, MCPAC, Audit Contract, Tires for IH truck, MTA recap- Holiday Meeting On a motion by Sup.
