September 11, 2007 Town Board Meeting
REGULAR MONTHLY MEETING- September 11, 2007
The Town Board of the Town of Cooperstown, Manitowoc County,
Wisconsin, convened in open session on September 11, 2007 at 7 p.m.,
at Town Hall for the purpose of transacting business as the Town
Board.
Chairperson Ross Johnson called the meeting to order at 7 p.m.
Pledge of Allegiance.
Roll Call: Chair. Ross Johnson, Sup. Joe Havlovitz, Sup. Mike Albers,
Sup. Fred Lemens, Sup. Chad Collins, Treasurer Bernadette Duescher,
and Clerk Sue Kornely. Constable Nancy Weber was absent. Seven
residents were present. Building Inspector Mike Angoli was present.
Dan Kasten and Randy Pelishek were also in attendance.
On a motion by Sup. Lemens and seconded by Sup. Collins, the agenda
was approved on a unanimous vote.
On a motion by Sup. Lemens and seconded by Sup. Collins, the August
14, 2007, closed session meeting minutes were tabled on a unanimous
vote.
On a motion by Sup. Collins and seconded by Sup. Havlovitz, the
August 14, 2007, meeting minutes were approved with amendment on a
unanimous vote.
Reports
Treasurer Bernadette Duescher presented the Treasurer’s Finance
Report. On a motion by Sup. Collins and seconded by Sup. Lemens, the
Treasurer’s Finance Report were approved on a unanimous vote.
Roadman Dan Kasten presented Road & Equipment Report. Roads are the
same, most of Johnson Dr is done, clean up on Kocian, patching on
Fairhills & Hickory Grove, frame on Pete fixed & painted, new truck is
nice, missing signs on Zander & Hickory Grove-Dan is investigating,
discussed yield sign on Hidden Valley and Marshek Rd, discussed
installing stop sign on Hidden Valley coming from Anderson’s, old
truck- advertise for bids. On a motion by Sup. Albers and seconded by
Sup. Lemens, an ad will be placed seeking bids for old truck-bids due
on Monday preceding next meeting, approved on a unanimous vote. Clerk
asked about set back on paving driveway for Jeff Charles.
Clerk Sue Kornely presented the Constable’s Report. Sept 10th Sup.
Collins responded to a call from sheriff about cattle on Remiker and
Marshek Rd, no cattle found-reported back to Sheriff’s office. County
R road repairs will be in September and October. Brey residence is
still an ongoing problem. Noise has ceased but junk has worsened after
checking with neighbors. Reed Gaedtke will follow up when he has time,
recent correspondence has been sent to him. Any violations will be
forwarded to the Manitowoc County Planning & Park.
Sup. Lemens presented the Plan Commission Report. - Sept 10th
meeting-reviewed Weber rezoning: set up for Oct 2nd, discussed
Pelishek Rezoning, discussed Rails to Trails, discussed zoning
procedure application, general map discrepancies and PC ordinance
changes.
Town Board reviewed the ordinance for revision to Plan Commission
2000-1 ordinance. Sup. Lemens moved and seconded by Sup. Albers to
table. Upon vote, the motion carried unanimously.
Sup. Lemens presented the Mtwc Cty Planning Advisory Committee
meeting- August 29th.
County split up into 5 sections: 4 groups of towns and 1 village/city
group, surveys will be taken to reflect needs
Building Inspector Mike Angoli reported a resident did not have the
correct forms for resident to being building. He suggested that he be
contact before issuing permit on new homes. Board discussed with
resident and Mike Angoli the correct procedures and will make
corrections going forward. Mike Angoli discussed the removal of
trailer house and replacement with new and the UDC requirements for
mobile homes and setbacks. Sup. Albers moved seconded by Sup.
Havlovitz to allow the replacement mobile home to be placed on a slab
at the same location. Upon vote, the motion carried unanimously.
Chair. Johnson asked for public input - none.
Unfinished Business
Case# 07 CV 138 Nancy Weber and Russell Norman and Teresa Norman vs.
Town of Cooperstown. Clerk Kornely stated three letters had been
received: Notice of Motion and Motion of Cost and Attorney fees-
totaling $7942.35, 2nd one Defendants objection, and 3rd is the
hearing set for September 18th at 9 am. Randy Pelishek asked why the
Board had not sent the rezoning to the Plan Commission. Clerk Kornely
read the Courts order. Board will send the request back to the Plan
Commission to review the rezoning request that is on hand.
Ordinances, Resolutions and Agreements
Sup. Albers moved, seconded by Sup. Collins to adoption of Resolution
2007-5 appointing LGPIF as insurance carrier. Upon vote, the motion
carried unanimously.
The Board signed the updated Roadman Contract.
Sup. Collins moved, seconded by Sup. Albers to adopt Operator license
for Rodney Gove. Upon vote, the motion carried unanimously.
Public hearings and advisory votes
Refund of Renier Rezoning Request fee: Board discussed the refund and
rezoning procedures, no request was made from Renier- no action taken.
Sup. Lemens had requested a need to vote on the rezoning request from
A3 to NA. Vote was deemed unnecessary by Chairman.
Discussion/approval of Four Year Road Plan- no action taken.
WTA Convention/ Budgeting & Community Growth Workshops- Board
discussed attendance.
Discussion of Town Website- Clerk Kornely provided info on website
design by Dustin Overbeck. He has been working with Tom Harnisch. Fees
are $995 (one-time) to create the website, $25 per yr maintenance &
hosting, and $10 per yr domain name. Discussed items that could be put
on the website.
Discussion on Emergency Government trainings- Clerk Kornely presented
the list from Nancy Crowley of classes that are required: 100 and 700,
100 is available on line. Clerk suggested setting up a class for
Board, Village of Maribel Board, fire department and rescue squad.
Discussion of Mtwc Cty Chapter 24 Large Wind Energy Systems & Chapter
10 Setback Ordinance- Clerk Kornely provided the Board a copy of
ordinances for review.
Laptop Computer for Town- Clerk Kornely suggested to the Board
getting a convertible tablet laptop at a cost of $1799 and printer for
about $99 for use at meeting. Detail of laptop discussed. Discussed
budget allowance under General Administrative Outlay.
November School Referendum- Clerk Kornely was informed by the County
Clerk there will be a referendum and discussed the fees involved with
referendum.
Procedural motions by members of town board
Treasurer Duescher presented two additional checks for approval:
Cellcom and Maribel Grain. Sup. Collins moved, seconded by Havlovitz
to approve checks. Upon vote, the motion carried unanimously.
Reviewed correspondence & upcoming events. Bids for Refuse/Recycling
will be requested for next months meeting due to clerk by Monday
preceding the next meeting. Submitted insurance claims have not been
responded too.
Future meeting agenda: Case# 07 CV 138, vote on laptop,
review/approval truck bids, discussion of PC ordinance, vote on
website, 4 Yr road plan, WTA Convention, Nancy Weber rezoning,
review/approval refuse/recycling bids, set date for budget workshop
Sup. Havlovitz moved, seconded by Sup. Albers to adjourn. Upon vote,
the motion was carried unanimously. The meeting adjourned at 8:55
p.m.
