COOPERSTOWN PLANNING COMMISSION SEPTEMBER MEETING MINUTES On site review called to order 6:30 pm at 13799 Rameker Rd Cato. PC Members present F. Lemens, D Blakeslee, B. Enz, & T. Kapinos. Public Present (4) Owners showed PC what they were requesting and explained the issue of the extra 1.22 ac.--the County indicates this is in C-1 and can not be rezoned. Adjourned to Town Hall 6:55pm. Meeting called to order by Chmn. Lemens on Sept 2-08 at 7:02 p.m. at Town Hall Roll Call: Present--Fred Lemens, Bill Enz, David Blakeslee, Tom Kapinos, and Pam Kouba (excussed-sick) (9) Citizens present Pledge Allegiance Approval of Agenda--Motion by_B. Enz_ 2nd_T. Kapinos_carried 4/0 Public Hearing open at 7:05 pm Chmn Lemens read the zoning petition. Steve Diedrich explained his thinking on the zoning request. Chmn Lemens called for opposition input on the request; none given. Randy Pelishek read two statement for the record, concerning the Commission’s prior position on zoning of natural areas. (written statement presented for record). Chmn Lemens called for approval input, with Dan Seering expressed approval. Chmn Lemens went through the zoning review questionnaire. Commission discussed the issue of zoning for Principle Ag (PA) over Natural Area (NA). T. Kapinos expressed a dislike to NA on 33.79 ac. because the two parcels being created should be be together under one zoning. Steve Diedrich indicated that County Park & Plan would not rezone the C-1 parcel of 1.22 ac. and he thought to request so would result in no approval on the total 35.01 ac. Motion to approve A3 to NA on 33.79 ac. by B Enz 2nd by T Kapinos carried 4/0 Chmn Lemens to write the final recommendation for presentation to Town Board. Public Hearing closed 7:50 pm Regular Mtng open 7:50 pm Approval of July 08 Minutes--Motion by_B. Enz_2nd_T Kapinos _carried 4/0 Public Input: John Kittell presented his rezone petition for 1.13 ac to A1, copies distributed. Public Hearing date for Oct 6th, 08 onsite set for 6:30 pm at 13423 Hostak Rd Maribel WI. Old Business: Sub Division Ord. update, J. VanLanen BLRPC discussed the issue with the PC. The PC presented him a copy of a previous discussed Ord. which he recommended deleting any defined acreage limits. He recomended the Ord. should require Town Board approval on any land division. Motion by D Blakeslee 2nd by B Enz to recommend that Town Board adopt the proposal from the March 08 meeting as amended. RECOMMENDATION LAND DIVISION CONTROL ORDINANCE FOR TOWN OF COOPERSTOWN General Provisions Area of Jurisdiction This Ordinance shall apply to all lands within the Town of Cooperstown. Applicability Any division of land within the Town of Cooperstown that results in a division of land as defined below shall be surveyed and a certified survey map (CSM) of the land division, shall acquire an approval recommendation by the Town Planning Commission and approval by the Town Board and then recorded by the Registered of Deeds for Manitowoc County. A minor land division is defined as the division of a lot, parcel, or tract of land by the owner thereof or owner’s agent, for the purpose of ownership or transfer of ownership or building development where the act of division creates: any lots, parcels, or building sites or any lots, parcels, or building sites by successive divisions from the same Mother Tract within a period of five (5) years. All area calculations are to be exclusive of any dedications, rights-of-way, easements, or reservations. The Certified Survey Map (CSM) shall be prepared by a registered land surveyor. It shall comply in all respects with the requirements of Section 236.34 of Wisconsin Statues. New Business: Smart Growth Plan updates; J. VanLanen discussed the issue and process. Suggested the October meeting establish the goals and objectives requiring change Ch 1 & 2. Review land use and implementation Ch 8 & 9. Board Input: T Kapinos raised the issue/situation concerning the ATV track in the Daenen & Janssen pit. The track is being used for charity events regularly. Inquired if the Town needs to adopt an Ord. establishing licensing and fees of such events.
