TOWN BOARD MEETING December 14, 2010
The Town Board of the Town of Cooperstown, Manitowoc County, Wisconsin, convened in open session on December 14, 2010 at 7:02 p.m., at the Maribel Community Center for the purpose of transacting business as the Town Board.

Chairman Duckett called the meeting to order at 7:02 p.m.

Roll Call: Chair. Richard Duckett, Sup. Nancy Weber, Sup. Jerry Skarda, Sup. Fred Lemens, Sup. Bill Enz, Treasurer Bernadette Duescher, and Clerk Sue Kornely. 4 residents were present. Dan Kasten was present.

On a motion by Sup. Enz and a seconded by Sup. Skarda, the agenda was approved on a unanimous vote.

On a motion by Sup. Lemens and a seconded by Sup. Enz, the October 25, 2010 Town Board Special Meeting minutes were approved as corrected on a vote of 4 to 1 . Sup. Weber voted no.

On a motion by Sup. Weber and a seconded by Sup. Skarda, the November 9, 2010 Town Board Monthly Meeting minutes were approved as corrected on a unanimous vote.

On a motion by Sup. Lemens and a seconded by Sup. Enz, the November 15, 2010 Town Board Special Meeting minutes were approved as corrected on a unanimous vote.

On a motion by Sup. Enz and a seconded by Sup. Lemens, the December 6, 2010 Public Budget Hearing minutes were approved on a unanimous vote.

On a motion by Sup. Skarda and a seconded by Sup. Weber, the December 6, 2010 Town Special Meeting minutes were approved on a unanimous vote.

On a motion by Sup. Lemens and a seconded by Sup. Enz, the December 6, 2010 Town Board Special Meeting minutes were approved on a unanimous vote.

Reports
Treasurer Duescher presented the Treasurer Finance Report. Discussion. On a motion by Sup. Weber and seconded by Sup. Lemens, the Treasurer’s Finance Report was approved on a unanimous vote.

Road & Equipment Report- Dan Kasten reported few broken up spots on Greenstreet Rd & Rosecrans Rd, ditch work completed, trees need trimming on Remeker Rd & Zander Rd , sanders on plows, wing and chains on grader. Chair. Duckett suggested contacting Propson Economy Tree Service to trim trees hanging into right of way. A chunk of blacktop missing on Pautz Rd –Town of Gibson reported by Sup. Weber.

Constable Report- Sup. Weber had a call on Saturday, the same dog has been taken home before, Village of Maribel has also taken this dog home twice. Sup. Weber suggested a letter be sent to the dog owner. Sup. Skarda had no calls.

Plan Commission Report. Sup. Lemens reported no meeting.

Building Inspector Report - Clerk Kornely had no inspections to report. Roger Mayer was called and offered the new position.

Public Comment: Heather Rezek reported that Scanlan had no dust control put on the road and a lot of traffic has increased the dust. The rain does not control the dust. Larry Wohlwend, owner of storage buildings west of Rosecrans, would like to build a third building. A conditional use permit from County was issued to Mr. Hansen for only 2 buildings of the 3 requested. If he applied to the County, would the Town Board be in approval of a 3rd building? He has 6 acres- less than 2 being used. 304’ from road to first building. Was a diagram submitted with building? Have you contacted the County- only to receive a copy of the conditional use permit from 1997.

Unfinished Business
Water Testing & Well Contamination/County Hwy R- Brown County Water Authority Results- Chair Duckett spoke with Jerry Halvorson- Watzka home at 18612 Hwy R has a new well, it tested positive for bovine. Heather Rezek asked about water testing with having a new baby. Nick Metz home has a new septic.

Vehicle Accident Report- Chair. Duckett spoke with Jeff Grip, adjustor. No update.

Wind Turbines Update-Discussion. Sup Skarda stated about half are running, he can see 6 of the 8. He cannot hear any noise. Sup Lemens is still working of the resolution.

Public Hearings-Discussion and Action, if needed.
Constable Appointments- no applications received.

Delinquent Personal Property taxes- Sup. Lemens reported the Gersek case has been filed with Manitowoc County and Brown Cty- a judgment of lien is in place.

Bridge Inspections- Pleasant Road construction, TRIP funds John Kropp completed NE quarter completed. Written report will be sent by end of year.

Elmer Road Ditching Update- Renter & property area has standing water in ditch- farmer had crops planted in the ditch. They have paid half of the cost of ditching. Total bill for ditching $800.

Manitowoc County General Zoning Ordinance- Town will review their land usage maps. Sup. Lemens gave a recap of the maps and zoning of A3- Exclusive Ag changes to EA. Suggestion Plan Commission and Town Board meet to set guidelines for removal from Exclusive Ag. Meeting will follow with public hearings with residents. Jan 19th there is a meeting with the County. Board will make a discussion on Jan 11th about having a joint meeting prior to meeting with the County.

Discussion on paunch- Sup. Skarda reported hauling for two days occurred across the road from him during deer hunting and was tilled in- it had a smell. After ground was frozen- one load was hauled in- no smell. Sup. Lemens reported on the town’s variance and copies made available to the town. Sup. Lemens will work on a form for Board to review. Loads are being hauled on non-truck routes.

Pleasant Road Bridge Design- Gary Kennedy reported to Chair. Duckett that we have been moved up on the funding list for Pleasant Road bridge. We need to contact bridge design firms for bids. On a motion by Sup. Skarda seconded by Sup. Enz to allow Chair. Duckett to contact Gary Kennedy for contacting bridge design firms was approved on a unanimous vote.

Scanlan Road Maintenance- Chair. Duckett reported that in early summer 2010, the decision was made not to put calcium on the road, due to the amount of rain. Next year, calcium will be applied. Discussion of Scanlan Road creating a 4 rod road and blacktopping. Discussion of posting road as no truck route.

Review of Code of Ordinance Chapters- Drafts- Discussion. Chair. Duckett would like to see 3-5 chapters ready for review. Sup. Skarda would like to review the old ordinances and add to Code before sending in for review. Sup. Lemens would like the old ordinances reviewed. Clerk Kornely suggested going thru the old ordinances and resolutions and divide them into incorporated into the Code or obsolete.

Ordinances, Resolutions and Agreements
Larry’s Hauling Contract- The terms and conditions were reviewed with the Board. Chair. Duckett signed the contact.

Humane Society Ordinance- Sup. Weber gave a recap of Manitowoc County Humane Society fees. On motion by Sup. Lemens and Sup. Weber, a resolution pertaining to disbursement of dog license fund surplus from Manitowoc County to the Town of Cooperstown, was approved on a unanimous vote. On a motion by Sup. Skarda, and seconded by Sup. Weber, a resolution pertaining to the impound agreement between Manitowoc County LHS and the Town of Cooperstown, was approved on a unanimous vote.

Procedural motions by members of town board
On a motion by Sup. Enz and seconded by Sup. Weber, checks approved on a unanimous vote.

Review of correspondence.

Future meeting agenda: January 11th- Wage increase, vacation payout, resolution- Discontinue mandated etc, Variance for industry waste spreading, typing of ordinances compensation for the clerk

On a motion by Sup. Skarda and seconded by Sup. Weber, adjournment was approved on a unanimous vote.

The meeting adjourned at 9:47 p.m.
