TOWN BOARD MEETING November 9, 2010
The Town Board of the Town of Cooperstown, Manitowoc County, Wisconsin, convened in open session on November 9, 2010 at 7:00 p.m., at the Maribel Community Center for the purpose of transacting business as the Town Board.

Chairman Duckett called the meeting to order at 7:13 p.m.

Roll Call: Chair. Richard Duckett, Sup. Fred Lemens, Sup. Bill Enz- excused, Sup. Jerry Skarda, Sup. Nancy Weber, Treasurer Bernadette Duescher, and Clerk Sue Kornely. 2 residents were present. Dan Kasten & Eugene Rabas was present.

On a motion by Sup. Lemens and a seconded by Sup. Skarda, the agenda was approved as amended on a unanimous vote.

On a motion by Sup. Lemens and a seconded by Sup. Weber, the October 12, 2010 Town Board Special Meeting minutes were approved on a unanimous vote.

On a motion by Sup. Skarda and a seconded by Sup. Lemens, the October 12, 2010 Town Board Monthly Meeting minutes were approved as corrected on a unanimous vote.

The Board discussed the minutes and tabled them until next month. On a motion by Sup. Lemens and a seconded by Sup. Skarda, the minutes were tabled on a unanimous vote.

Maribel Fire Department contract. Eugene Rabas present the Board the 2011 Fire Service Contract. On motion by Sup. Skarda and seconded by Sup. Weber, the contract for a rate of 75% of 1 mil, was approved on a unanimous vote.

Reports
Treasurer Duescher presented the Treasurer Finance Report. Discussion. On a motion by Sup. Lemens and seconded by Sup. Weber, the Treasurer’s Finance Report was approved on a unanimous vote.

Road & Equipment Report- Dan Kasten reported nothing on roads, JD 6605 tractor new pipe, posts for snow fence about ¾ installed, and about two weeks on grass cutting left. Sup. Weber asked about the culvert on Zander Rd for VanderKinter. Dan reported gravel was put over the existing culvert and the culvert by Jensen was moved to the top of the hill.

Constable Report- Sup. Weber had a call on bear tracks on Roy Nemetz farm. Dates of siting are needed. Sup. Skarda had no calls. Sup. Lemens would like constable contact on website in the intern- Weber & Skarda.

Sup. Lemens presented the Plan Commission Report. No meeting. Manitowoc County is working on Chapter 8.

Clerk Kornely presented the Building Inspector Report- Wetencamp & Pantzlaff final inspections.

Public Comment: Al Chvala representing the Denmark Snowmobile trail. Last year permission was granted by adjacent land owner around the Hostek Rd for one year. This year one owner is not willing to grant access. The Board was asked if permission could be obtained to use the road to cross the trail. Sup. Skarda asked about proper signing. The Board will add to December agenda for discussion and decision.
Al Chvala asked if the Board ever considered removal of the Hostek Bridge. Sup. Lemens gave a brief update on previous discussions. Sup. Weber has discussed with Paul Rabas about use of the Maribel Fire Hall for meetings. Paul will bring before their Board and will report back on availability.

Unfinished Business
Water Testing & Well Contamination/County Hwy R- Brown County Water Authority Results- Chair. Duckett reported pot hole has been filled. Sup. Lemens asked about the well installation. No report.

Vehicle Accident Report- Chair. Duckett spoke with Jeff Grip, adjustor. Still under chiropractic care, insurance has not been settled.

Wind Turbines Update-Discussion. Chair. Duckett was called by New Denmark resident about water testing prior to operation of the windmill start up. Sup. Lemens reported no new rules have been passed. Sup. Lemens asked if he should draft a resolution against the mandated requirement that 10% of energy be produced by green renewable energy. Chair. Duckett gave approval for the draft. Sup. Weber presented a special use permit for roads for review by the Board. Sup. Weber did speak with an appraiser on land devaluation due to windmills (Windmill Ghettos).

Pine Drive Update-Discussion. Dan Kasten reported culvert installed with one more load of gravel. Propson Tree Trimming completed trimming. There are some pieces left to be cut up. Stump removal needed.

Public Hearings-Discussion and Action, if needed.
Constable Appointments- no applications received. Sup. Skarda would like to present to the electors at the Annual meeting for the position to be elected or appointed. Sup. Lemens will write up an editorial for the Denmark News about the vacant constable seat.

Delinquent Personal Property taxes- Sup. Lemens reported he contacted Barb from Gersek to set up the 3 payment plan and she has not responded back. By November 9th, Gersek was to file with the Courthouse reason for non-payment. A new hearing is set for Dec 17th.

Code of Ordinance- Discussion. Sup. Lemens reported the Board met to discuss. Sup. Skarda feels it will take until January or February to complete drafts. Board will discuss Chapter 5 & 9 at next ordinance meeting.

Bridge Inspections- Pleasant Rd Chair. Duckett reported he had no contact with John Kropp. Dan Kasten reported the bridges are clean, but some trees need trimming. Bridging inspection should be completed by end of year.

Building Inspector Discussion- Clerk Kornely reported the only interested parties are Roger Mayer of Newton and Larry Maloney of Manitowoc. Board would like to meet with candidates at November 15th meeting.

Town Posting Sites- Chair. Duckett reported the St James church committee needs to discuss the posting site before rendering a decision.

Set Budget Meeting & Hearing- Set for December 6th at 7 p.m.

Ordinances, Resolutions and Agreements
2010 Budget Amendment- On a motion by Sup. Skarda and seconded by Sup.Weber , to amend the budget by moving $3736 from Undesignated Fund to Hwy Maintenance, approved on a 3/1 vote. Sup. Lemens voted no. On motion by Sup. Skarda and a second by Sup. Weber to amend the budget by moving $1500 for Hwy Building Outlay account to Hwy Maintenance, approved on a unanimous vote.

Operator License for Stacey Chastain- On a motion by Sup. Lemens and a seconded by Sup. Skarda for approval of the Operator License for Stacey Chastain, approved on a unanimous vote.

Procedural motions by members of town board
On a motion by Sup. Skarda and seconded by Sup. Lemens, checks approved on a unanimous vote.
On a motion by Sup. Skarda and seconded by Sup. Weber, a check for MTA meeting/Xmas Party, approved on a unanimous vote. On a motion by Sup. Lemens and seconded by Sup. Skarda, a check for Kerber & Rose & Assoc for $5200 for F’08 Audit, approved on a unanimous vote.

Review of correspondence. Sup. Skarda reported on newsletter on the digester. Sup. Lemens spoke about WTA meetings on Land Division.

Future meeting agenda: November 15th- Building Inspector Presentation, Delinq PP taxes, Budget workshop, Ordinance meeting; December 6th Special Meeting, Hearing & Board Meeting- approve of budget and Ordinance meeting; December 2010 Monthly- water testing, accident report, wind turbines, Constable appointment, Delinq PP taxes, Bridge Inspection, Building Inspector, Town Posting site, snowmobile route on Hostek Rd

On a motion by Sup. Weber and seconded by Sup. Skarda, adjournment was approved on a unanimous vote.

The meeting adjourned at 8:57 p.m.
